Small Claims Lawsuit filed Nov 8 '02:

 

Since the Hawaii Office of Consumer Protection declined to do anything more than require Oceanic to include a disclaimer in future advertising, Oceanic has declined to communicate with me regarding my complaint.  On November 8, 2002, I filed a lawsuit on my behalf in Hawaii Small Claims Court seeking $998.47. (A class action would be nice - but, so far, it's out of reach.)

On December 3, John Komeiji, a partner at Watanabe Ing Kawashima & Koemiji, flew from Honolulu along with Kiman Wong, General Manager Oceanic Internet Services for the 8:30AM court date. The proceedings took 5 minutes - Mr. Komeiji denied the complaint, and indicated to the judge that Oceanic did not wish to attempt mediation. A trial date was set: January 10, 2003 at 1PM. You don't need to be an accountant to realize this is costing Oceanic way more than the $998. I seek. Perhaps they're scared that if I win, others may follow filing similar claims?

Because the trial is pending, and this site is viewed by Oceanic via ipuka, the external "Internet hole" for Oceanic's LAN, I'm not going to say much more about all this for now, except: it is very easy to file an action in Hawaii Small Claims Court - the filing fee is only $35.
